yeah Believe Supreme Court has ruled recording is protected and ten feet is distance. This just allow officers to false arrest people filming , claim harrasment when none happened . Lawyers make money, charges probably dropped . First amendment restricted further.,lather ,rinse ,repeat.

DeleteAnd the HALO law says nothing about recording. It was the civil liberty groups, that you're probably a card-carrying member of, that mentioned that.
I don't have a problem with such a law per se. The problem will be in how it is enforced. Without a tape measure 25 feet is an arbitrary number subject to error and interpretation. We will see people 30+ feet away arrested and prosecuted and we will see others ignored while actually within that distance. As is the case with many laws the real world application will suck.
ReplyDeleteI think the distance is designed to be an arbitrary number. It is just to have that boundary there. Most of the time the boundary will be encroached upon and nothing will be said because the people encroaching will be friendlies. When the crowd becomes disruptive, the boundary will be more likely to be enforced. Most laws aren't perfect.
DeleteNo offense Dan, but that's a stupid argument. You need an objective measure. If the law said "safe distance away" then everyone is going to argue over the meaning of "safe" until the relevant court says "25 feet".
DeleteAnyone with depth perception should easily be able to train themselves to spot if something is 25 feet away, nearer, or farther. Very much like you can train yourself to spot if a car is going above or below 25mph.

25 feet is more than reasonable. Every cell phone I've had in the last 10 years has had a zoom feature. You'll get better context shots at 25 feet than you would at 10 feet. Of course, if your goal is to not capture the context so that you can spin a narrative....

DeleteAnd the only reason they mention a definitive measure is so people know there is a boundary. Few, if any, people are going to be arrested for being 19 feet away.
