The Biden-Harris administration on Friday officially withdrew a proposed Title IX rule that would have forced all publicly-funded schools to largely allow males to participate in female sports if the athletes “identify” as female.
The administration admitted that the decision to withdraw was because of public backlash, and the numerous lawsuits that were sparked from the gender rule-change.
“In light of the comments received and those various pending court cases, the Department has determined not to regulate on this issue at this time,” Secretary of Education Miguel Cardona said in a five-page docket published Friday.
According to Cardona, the Department of Education received more than 150,000 public comments about the proposal, National Review noted. “Commenters offered a broad spectrum of opinions,” the docket said, adding, “there are multiple pending lawsuits related to the application of Title IX in the context of gender identity.”
The proposed change would have barred schools and colleges from outright banning males from girls’ athletics, largely permitting males who identity as females to compete. There was, though, a vague loophole offered for schools to ban some male athletes if they could prove it affected safety and fairness and served “important educational objectives.”

 Florida victorious in bid to strike down Title IX rewrite, injunction granted.

TALLAHASSEE, Fla. – The U.S. 11th Circuit Court of Appeals granted Florida and other states an injunction against the Biden administration’s newly revised Title IX rule, which significantly broadens the definition of sex discrimination to include gender identity.
The ruling temporarily halts the enforcement of the rule within the plaintiff states, which include Florida, Alabama, Georgia and South Carolina.
“We will never allow the woke mob to infringe upon the safety and opportunities of women,” said Education Commissioner Manny Diaz Jr. “This injunction is one step closer to putting an end to the Biden Admin’s attack on women.”
The Biden administration’s changes to Title IX, a law originally enacted in 1972 to prevent sex-based discrimination in federally funded education programs, have faced strong opposition from several states and advocacy groups.
Opponents, such as Florida and Attorney General Ashley Moody, argue that the revised rule oversteps its bounds by expanding protections beyond what was originally intended under Title IX.
In its decision, the court highlighted that prior to this ruling, seven district courts and two other courts of appeals had already issued preliminary injunctions against the enforcement of the rule in various jurisdictions across the country.
The 11th Circuit’s ruling follows a similar trajectory, agreeing with the plaintiffs that the rule’s enforcement should be halted while the legal battle continues.
The injunction marks a significant victory for Florida and its allies, who have argued that the new Title IX provisions could undermine opportunities and safety for young girls and women in educational settings.
Gov. Ron DeSantis and Moody have both expressed their commitment to fighting the rule, saying that it poses a threat to women’s rights in sports and education.
The U.S. Department of Education, which promulgated the new rule, now faces a setback as the case proceeds through the courts.
The administration has defended the rule as a necessary update to reflect modern understandings of gender and sexual identity, aiming to ensure that all students receive equal protection under the law.
The injunction remains in place as the legal challenges against the Title IX revisions continue.

Florida Board of Education passes rule ensuring high school sports separated by biological sex.

MIAMI – The State Board of Education reinforced its stance Wednesday to protecting the integrity of women and girls in sports by determining a student’s biological sex, and not gender identity, will be the factor to participate in the Florida High School Athletic Association.
“I’m grateful that the State Board of Education took decisive action on critically important topics today, especially for women and girls,” Commissioner of Education Manny Diaz Jr. said. “Florida will never compromise on the health, safety and well-being of our students and educators. Whether it’s the integrity of athletics or safety on school campuses, we are absolutely committed to doing what’s right.”
The board unanimously approved the new bylaws for the Florida High School Athletic Association, or FHSAA, for the upcoming 2024-2025 school year. The rule ensures students will compete in athletics based on their biological sex, at birth.
In its stance, the board declared the rule “preserves fair opportunities for female athletes” in accordance with Gov. Ron DeSantis’ policies and the Florida Department of Education. It also noted the decision as a direct contrast with what Florida critics have called the Biden administration’s assault on Title IX protections for women and girls, in favor of transgender people.
Diaz affirmed Florida’s stance to state superintendents and charter school leaders in April, stating no “educational educational institution should begin implementing any such changes until further notice.”
Florida has since filed a federal lawsuit against the U.S. Department of Education regarding its changes to Title IX.
“The Board’s action is consistent with Florida’s fight against the Biden administration’s attempt to make radical changes to Title IX protections affecting women and girls, effective August 1, 2024,” the release said. “If successful, the federal anti-discrimination law’s longstanding application of biological sex will no longer have any meaning, as gender identity will be included within the term ‘sex.’”
The board also affirmed protecting students, teachers, and staff by updating its school safety requirements. The guidance is a direct reflection of HB 1473, which focuses on campus access control.
HB 1473 was sponsored by Reps. Dana Trabulsy, R-Fort Pierce, and Christine Hunschofsky, D-Parkland. It was then approved by DeSantis in May.
Among its details, the law changes a vast array of school safety requirements. They include gates, access points, classrooms and instructional spaces will remain closed and locked with students on campus.
The law also requires age-appropriate instruction of FortifyFL, a suspicious activity reporting tool, within the first five days of school. It also entails all classrooms and instructional spaces also clearly marked “safest area”
Furthermore, annual inspections of public schools by a School Safety Specialist as well as unannounced compliance inspections of every public and charter school are required over a 3-year period by the Florida Department of Education’s Office of Safe Schools under the law.

The Department of Education has released it's changes to Title IX. The twisted and increasingly authoritarian Biden administration, who tout themselves as the leaders of the "Party of Science" just virtually eliminated what we have known as girl's and women's sports in the USA.  The new final rules re-write discrimination as "based on stereotypes, sexual orientation, gender identity, sex characteristics.” But not actual sex.
In other words, Government is eliminating sex-based categories and distinctions. They're gaslighting us into accepting that there is no actual difference between males and females. People who aren't familiar with US law won't understand how radical this is.
If implemented, it will guarantee preference for trans over women in many situations. There is only gender identity, sexual orientation, and sex “characteristics” which are not the same as biological sex.

 

They are playing games with language. And smuggling in lies. National Women's Law Center President Fatima Goss Graves, the liberal witness at the Title IX hearing, said that female athletes should "learn to lose gracefully" -- to biological men.
This is exactly the type of far-reaching “rule change” that should require a vote from Congress. No nameless DC bureaucrat should have the power to impose their ideology on the entire country, let alone impose a “rule” to effectively negate the law as written. The Department of Education has no power to rewrite a law that was passed by Congress. Any changes to Title IX would have to come from Congress.
My guess is that it will be overturned...but with that said, you mind fucked LADIES, you cried for this. You were the ones demanding "equity", "equality", "fairness" and "tolerance" for men in dresses.  Florida bans gender identity from driver’s licenses.

TALLAHASSEE, Fla. – Florida rescinded a rule that allowed residents to change their driver’s license gender notation to correspond with an “internal sense of gender role or identity,” according to a memo obtained by Florida’s Voice.
Rep. Anna Eskamani, D-Orlando, blew the whistle on the change this week.
“This is another gross example of how every state agency has been weaponizes to attack trans people. Instead of addressing the property insurance crisis, this is what our state is doing,” Eskamani said. “Shameful.”
Florida Department of Highway Safety and Motor Vehicles Deputy Director Robert Kynoch wrote to all state county tax collectors that licenses can no longer be reissued for the purpose of reflecting one’s gender identity, arguing that policy hampered “the state’s ability to enforce its laws.”
“Permitting an individual to alter his or her license to reflect an internal sense of gender role or identity, which is neither immutable nor objectively verifiable, undermines the purpose of an identification record,” the letter said.
The department wrote that replacement licenses are only allowed when it is lost, stolen, or if there are changes to the person’s name or address.
“The term ‘gender’ […] does not refer to a person’s internal sense of his or her gender role or identification,” it said. “[It] has historically and commonly been understood as a synonym for ‘sex,’ which is determined by innate and immutable biological and genetic characteristics.”
The letter said that keeping licensees’ classification in line with their immutable characteristics is important because of the license’s “critical role in assisting public and private entities in correctly establishing the identity of a person presenting the license.”
Bryan Griffin, press secretary for Gov. Ron DeSantis’ political team, called the action “the right move.”
“Government should not affirm radical, anti-truth ideologies like ‘gender fluidity,'” Griffin said.
Florida lawmakers are also considering legislation requiring biological sex on driver’s licenses.
