Power Grab: Biden Admin Tries to Control National Guard, Texas Gov. Greg Abbott Claps Back.

In yet another power grab by the Biden Administration, the Defense Department in March asked Congress to override an existing law that requires governors to approve changes to National Guard units. The proposal would allow the Defense Department to have unilateral power to transfer units to the Space Force because perhaps they’re preparing for an alien invasion or something.
Texas Governor Greg Abbott (R), long a thorn in the side of Biden on the illegal immigration issue because the president refuses to protect our borders while the Republican governor takes the border invasion seriously, is fighting back and pointed out in a letter to the White House that the move would shatter long-time precedent.
“Although the Texas Air National Guard does not have these types of missions, I strongly oppose any attempt to sideline governors when it comes to their respective National Guards,” Abbott wrote in his letter, dated May 3. "Congress has long required the consent of a governor before units can be transferred out of the National Guard he commands.

Abbott argued that the proposal would set a dangerous precedent and was nothing more than a “power grab.”
“By departing from this sensible arrangement and allowing the Secretaries to dismantle National Guard units on a whim, Legislative Proposal 480 would set a dangerous precedent. Members of the Texas National Guard must always stand ready to respond to natural disasters, civil disturbances, and cartel activity that threaten our way of life,” Abbott continued.
The idea seems to be universally loathed by the nation’s governors of states, territories, and commonwealths, a majority of whom (including even leftist CA Gov. Gavin Newsom) signed a letter to Defense Secretary Lloyd Austin on April 29 expressing their “strong opposition” to the change, saying that it “undermines over 100 years of precedent as well as national security and military readiness.” Notably missing—Greg Abbott and Florida Governor Ron DeSantis, but now Abbott has responded and DeSantis did separately as well*.

One can only speculate as to why Biden Inc. would try to reclassify National Guard units to the Space Force, but it seems more than coincidental that more than a dozen Republican governors have sent state National Guard soldiers to help cope with the disastrous Biden border since 2021. Hmm.
One way for Biden to stop that upstaging and embarrassment is to simply move those personnel into the Space Force and prevent them from helping at the border.
While the media and wild-eyed progressives continue to claim that Trump would be the next Hitler should he be reelected, it’s actually Biden—or whoever is controlling him—who has weaponized the Justice Department, defied the Supreme Court, and made heavy-handed moves like this one that reek of an effort to give the federal government more and more power at the expense of the states and their citizens.

A Texas National Guard soldier deployed from McAllen to Eagle pass under Operation Lonestar was busted for attempting to smuggle an illegal immigrant in a government vehicle on Sunday.
Kinney County Sheriff Brad Coe says the soldier turned around when he approached a pop-up tactical Border Patrol checkpoint off 674 in Kinney County that had only been operational for a few days—The behavior alerting agents who attempted to stop the suv—The sheriff says Texas DPS got involved with the pursuit and used spike strips which ultimately stopped the vehicle.
KCSO assisted in the stop—TX DPS is currently investigating but sources tell me the soldier did not have access to the license plate readers or other technology that would have aided him in his efforts. He was armed so that escalated the smuggling charge. Sources say he was promised $5-6k to transport that one individual.

Many of the illegal immigrants who stormed the southern border on Thursday by breaking down razor wire and fencing before pushing into National Guard troops were reportedly processed and released into the United States after the incident.
Video captured by New York Post reporter Jennie Taer showed hundreds of illegal immigrant men charging the border in El Paso, Texas, and appearing to assault National Guard troops. According to Taer, many of these men were processed by Border Patrol under Title 8, a measure that allows illegal immigrants to be released while their asylum claims make it through the courts.

Texas Governor Greg Abbott announced Friday that his administration is building a Forward Operating Base in the Del Rio sector to house Texas National Guard soldiers who have been deployed to stem the illegal immigration crisis that has been unleashed under President Joe Biden.

Abbott said at a press conference that the new Texas Military Department base camp will assist in the state’s efforts to secure the border.
The governor’s office said that the Texas Military Department acquired 80 acres of land in Eagle Pass to build the base that will regularly house up to 1,800 soldiers and will have the capacity to house up to 2,300 soldiers if needed. Soldiers will have their own rooms in addition to amenities that include a dining facility, a recreation center, laundry facilities, WiFi access, chaplaincy programs, and various health services.
“In the coming weeks, we will also be expanding operations north and south of Eagle Pass, putting up additional barriers to fortify our border,” said Adjutant General of Texas Major General Thomas Suelzer. “We are also adding three more fan boats and expanding our drone program radar truck capabilities.”
Abbott said that the base was “going to dramatically improve conditions for our soldiers” because they were currently “scattered across this entire region in cramped quarters, away from fellow soldiers, and sometimes traveling long distances to do their job.”
Texas, since launching Operation Lone Star, has spent billions of dollars trying to secure its border with Mexico.
“The multi-agency effort has led to over 500,000 illegal immigrant apprehensions and more than 39,500 criminal arrests, with more than 35,600 felony charges,” the governor’s office said. “In the fight against the fentanyl crisis, Texas law enforcement has seized over 467 million lethal doses of fentanyl during this border mission.”

The Biden administration had initially warned Texas that it had until mid-day Friday to relinquish control of Shelby Park, the nearby boat dock, and the International Bridge. That deadline has now come and gone, and instead of there being a major clash between the Border Patrol and the state-controlled soldiers on site, it appears those on the ground have already de-escalated the situation.
The Border Patrol Union ends by slamming Biden for creating the current "catastrophe" and reiterating that there will be no conflict between CBP agents and state forces. The statement is a clear signal of support for the Texas National Guard, its mission, and those leading it, including Gov. Greg Abbott.
Rank-and-file BP agents appreciate and respect what TX has been doing to defend their state in the midst of this catastrophe that the Biden Admin has unleashed on America.

Furthering the division between the Border Patrol and the White House was a senior CBP official who said they have no plans to follow through on removing the razor wire put up by Texas. Biden has completely lost whatever leverage he had.

This is an incredible turn of events. I don't know if "mutiny" is the right word here, but clearly, Biden has no way to enforce his threats at this point. Border Patrol agents are not going to go along with it and short of using the Insurrection Act to mobilize the U.S. Army (and they likely wouldn't act either), this represents a major roadblock to the president's attempts to further destroy the Southern border.
We are in uncharted territory right now, and I'm certainly thankful cooler heads have prevailed, at least at this point. Will this force Biden's hand toward some kind of renewal of enforcement of immigration laws? Surely, with his bluff having been called by his own law enforcement officials, he has to try a different approach. Never underestimate the propensity of Washington politicians to keep making the wrong decisions, though.

BREAKING: Greg Abbott declares INVASION at the border, invokes constitutional “right of self-defense.”

Governor Greg Abbott is not messing around. He has just declared an invasion at the border using the constitutional authority given to the states in Article I and has invoked the right of the state to defend itself.
He writes that this constitutional authority “is the supreme law of the land and supersedes any federal statutes to the contrary.”

The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary. The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border.

 Texas AG tells Biden administration to pound sand in response to threatening DHS letter.
'The facts and law side with Texas,' said Ken Paxton, attorney general of the Lone Star State.

Texas seized control last week of a 47-acre municipal park in Eagle Pass where hordes of illegal aliens have poured into the homeland in recent months and years. In doing so, the state ousted the federal border agents camped within who were otherwise handcuffed by the Biden administration's apparent unwillingness to enforce immigration law and secure the border.
The Biden administration was enraged by the Lone Star State's effort to reinforce American sovereignty. The Department of Homeland Security sent a strongly worded cease-and-desist letter to Texas Attorney General Ken Paxton Sunday, demanding Texas cave and grant federal agents "full access to the U.S.-Mexico border in and around the Shelby Park area."
Paxton responded in a Jan. 17 letter effectively telling the Biden administration to pound sand.

Addressing a vulnerability.
Texas took control of Shelby Park on Jan. 10 under an emergency declaration from Republican Gov. Greg Abbott in an effort to stem the flow of illegal aliens into the state. The park adjoins a high-traffic 2.5-mile stretch of the Rio Grande where the state's floating barrier was installed to dissuade migrants from fording the river.
The Texas National Guard established fencing around the perimeter of the park and blocked entrances to the river with the aid of border barriers and soldiers. While the state permitted U.S. Border Patrol agents access to the boat ramp in the park and entry if responding to a medical emergency, it appears to have otherwise barred access and entry to federal agents.
"Texas has the legal authority to control ingress and egress into any geographical location in the state of Texas, and that authority is being asserted with regard to that park in Eagle Pass, Texas, to maintain operational control of it," said Abbott.
Abbott spokeswoman Renae Eze said in a statement, "Texas is holding the line at our southern border with miles of additional razor wire and anti-climb barriers to deter and repel the record-high levels of illegal immigration invited by President Biden's reckless open border policies."
Blaze News previously noted that over 300,000 illegal aliens stole into the U.S. over the southern border in December, the highest monthly tally on record. That puts the total for this fiscal year at over 800,000, not including all of the recent border crossings that have gone unreported.
2.47 million, 2.37 million, and 1.73 million illegal aliens entered the United States in fiscal years 2023, 2022, and 2021, respectively.
Biden administration lashes out.
White House spokesman Angelo Fernandez Hernandez blasted the park seizure as an "extreme" political stunt purposed to "demonize and dehumanize" people, reported Bloomberg.
"Governor Abbott has repeatedly proven that he is not interested in solutions and only seeks to politicize the border," wrote Hernandez.
While White House officials beat their chests, Jonathan Meyer, general counsel for the DHS, sent a letter to Paxton on Jan. 14 complaining that Texas had ousted U.S. Border Patrol from the park and denied it access following the seizure.
After suggesting the DHS was "committed to securing the border," Meyer claimed the Lone Star State's actions "conflict with the authority and duties of Border Patrol under federal law and are preempted under the Supremacy Clause of the Constitution. Texas's actions also improperly seek to regulate the federal government."
Extra to accusing Texas of flouting federal law, Meyer blamed Texas for the recent drowning of three illegal aliens. The DHS general counsel intimated in his letter that the migrants perished after allegedly having trouble stealing into the country via the Shelby Park area and could alternatively have been saved by Border Patrol agents, hampered by Texas officials.
"Texas's failure to provide access to the border persists even in instances of imminent danger to life and safety," wrote Meyer.
The DHS issued the following ultimatum: "If you have not confirmed by the end of day on January 17, 2024, that Texas will cease and desist its efforts to block Border Patrol's access in and around the Shelby Park area and remove all barriers to access to the U.S.-Mexico border, we will refer the matter to the Department of Justice for appropriate action and consider all other options available to restore Border Patrol's access to the border."
Texas doesn't blink.
Paxton did not mince words in his reply, obtained by the Daily Caller: "Your letter misstates both the facts and the law in demanding that Texas surrender to President Biden's open-border policies. Because the facts and law side with Texas, the State will continue utilizing its constitutional authority to defend her territory, and I will continue defending those lawful efforts in court."
The Lone Star State's attorney general stressed that the DHS "should stop wasting scarce time and resources suing Texas, and start enforcing the immigration laws Congress already has on the books."
In his letter, Paxton cast doubt on several key claims made in the DHS letter, noting that:
• Texas was not impeding lifesaving care for illegal aliens and continues to permit access to U.S. Border Patrol "responding to a medical emergency";
• contra to Meyer's claim that the DHS is committed to "'rendering emergency assistance to individuals in need,'" it allegedly absolved itself of such a duty in 2023 "and advised the Texas Department of Public Safety that federal personnel would not be present to administer aid unless Texas called for help";
• the migrants who drowned did so on the Mexican side of the river, and the U.S. federal agents present as the incident unfolded "did not even have a boat, and they did not request entry based on any medical exigency";
• safety threats facing migrants were the product not of Texas border defenses but of Biden administration polices, adding "nobody drowns on a bridge"; and that
• per 8 U.S.C. § 1357(a)(3), U.S. Border Patrol's lawful, warrantless access to borderlands is only "for the purpose of patrolling the border to prevent the illegal entry of aliens."
Paxton concluded his letter noting, "President Biden has authorized DHS to send a threatening letter through its lawyers. But Texas has lawyers, too, and I will continue to stand up for this State's constitutional powers of self-defense. Instead of running to the U.S. Department of Justice in hopes of winning an injunction, you should advise your clients at DHS to do their job and follow the law."
Within hours of the DHS' reception of Paxton's defiant message, the Biden administration was dealt another blow, learning that the Lone Star State's controversial floating wall wasn't going anywhere.
The U.S. Court of Appeals for the Fifth Circuit reversed a December order requiring Texas move its floating barrier on the Rio Grande, reported the Associated Press.

As noted, even The Washington Post had to throw a flag on that one. Republicans did not try to reduce the number of Border Patrol agents. On the contrary, their proposal specifically protected the CBP from any manpower cuts. Jean-Pierre can't help but repeat her lie, though, because she's absolutely shameless.
It's always disconcerting to me what politics does to people. It's one thing to be passionate. It's another to stand up in front of people day after day and lie to their faces for perceived political gain. That takes a certain psychosis, and Jean-Pierre has it in spades.
All three of her claims were false. All of them were fact-checked, and she can still sit there with a straight face and insist everyone but the White House is wrong. I guess you could admire the consistency, but is it really admirable? Or is it just disturbing?

 Border Patrol Chooses Sides After Abbott Seizes Land in Overrun Eagle Pass.

Amid the still-worsening border chaos created by the policies of President Joe Biden, Texas has refused to accept what the Secretary of Homeland Security still can't bring himself to call a "crisis." The Lone Star State's latest action on Thursday: seizing a swath of city-owned parkland along the Rio Grande in Eagle Pass, kicking federal border agents off the property, and enforcing the international border with Mexico.
Rather than being upset that they've been booted from Shelby Park by Texas officials, the Border Patrol union welcomed the state action. In a statement, the Border Patrol union said that "Governor Abbott is not harming Border Patrol operations, he is enhancing them." The union further explained that Abbott "seizing control of Shelby Park allows our agents to deploy to troubled spots that experience high numbers of gotaways. Governor Abbott’s actions should be seen as a force multiplier," the statement added.
What's notable in this situation is that Border Patrol, a federal agency, is siding with Texas Governor Greg Abbott over Biden and Mayorkas. And why wouldn't they? The Biden administration has continued to make the job of border agents exceedingly impossible, often taking them off their regular duties to instead act as drivers, babysitters, and chaperones to help with processing record numbers of illegal immigrants.
At the same time, the federal government has ordered its agents to dismantle physical barriers set up by Texas, sued to block state policies to address the crisis, and insisted that Biden's policy is "humane" and what Texas is doing is somehow morally wrong.

Fox News reporter Bill Melugin has just posted that Texas has confirmed that they have indeed seized control of city property and are blocking access to the land, even to the Border Patrol.

The Texas Military Department confirms the TX National Guard has seized control of Shelby Park in Eagle Pass (city property where mass illegal crossings are), and is restricting Border Patrol from accessing the area, saying the Feds “perpetuate illegal crossings”. This is the area where Border Patrol has been cutting TX razor wire. Razor wire and fences are now deployed to block the area off from the public and federal government. Attached video is from our crew on the ground this morning as they began blocking it off.

Texas Military Department statement:
“The Texas National Guard has maintained a presence with security points and temporary barrier in Shelby Park since 2021. The current posture is to prepare for future illegal immigrant surges and to restrict access to organizations that perpetuate illegal immigrant crossings in the park and greater Eagle Pass area.”
