There are Constitutional protections (1st Amendment) against prosecution for burning the flag. I will personally despise you if you burn an American flag but if you paid for the flag and you're burning it in a manner that is within legal guidelines, you do you ... (spit).
The EO that Trump signed passes Constitutional muster. It says that if someone is burning a flag, law enforcement should pay attention to any ancillary laws they may be breaking. If you pull down someone else's flag and burn it ... that's petty theft and/or destruction of property plus the charge of burning the American flag. Pour gas on the American flag and burn it in the town square ... violating fire codes and/or burn restrictions plus the charge of burning the American flag. Sitting in your front yard in a lawn chair burning the American flag you paid for ... no charge. (spit)
It didn't help that Trump said 'burn a flag, go to jail for a year.' The EO doesn't say that.

DeleteRhetorical (I know it is not your position): Why is it okay to burn the American flag but not the gay flag? I'm 100% in on the 1st, but I want it to apply to all speech, not just leftists' speech.
ReplyDeleteAnd I agree with you 100%. I remember when people were charged with hate crimes for defacing/doing burn-outs on queer painted crosswalks. If they had been painted like an American flag, would there have been charges ... no.
